As I believe everyone is aware, the Supreme Court ruled in favor of gay marriage in a 5-4 decision. This decision not only mandates that all states must issue marriage licenses to gay couples, but also that all other states must recognize these marriages.
I encourage everyone to read the majority and dissenting opinions in this case. These are fascinating to read and frame the argument every way you can. Overall, from these opinions, you sense that all of the justices supported gay marriage. The dissenting opinions simply focused on the need for the legislature to create a law to recognize the validity of gay marriage and not have the courts create a law through legislative decree.
So, how does the law potentially impact businesses and benefits plans? Employers in states that now have to offer benefits to same-sex spouses need to make changes to their plans in order for those to be covered. Plan changes could mean cutting domestic partnership benefits as a way to consolidate their plans, as well. Those plans that were not offering same-sex benefits prior to the ruling will feel the biggest impact, as they may have to make big changes to include more people. Employers need to determine how these changes could affect their business as far as employee recruitment and retention.
