Shed Some Light On Your Job Descriptions

The sun. The outdoors. It’s time to soak up those extra hours of daylight. With more time, there’s more of an opportunity to refresh your company’s job descriptions. Having your real estate company’s job descriptions up-to-date and accurate is crucial for attracting the right employees. Many times, those seeking jobs can see a description, but not apply because the information doesn’t appeal and/or apply to them. Items like compensation levels, experience needed and responsibilities can determine whether or not someone actually applies for the position.
But more importantly, you should ensure all job descriptions fully encompass all specifics of the job so it doesn’t evolve into a legal issue down the road. Did you know a job description can become an employer’s defense against a claim of alleged disability discrimination under the Americans with Disabilities Act (ADA)? As a reminder, here are the requirements from the ADA:
- A job description should describe what the essential job functions are, and employees or applicants who can’t aren’t considered a qualified individual.
- Employers with 15 or more employees must provide reasonable accommodations to qualified individuals with disabilities.
The job description is also the basis for determining compensation and the position’s exempt or nonexempt status under the Fair Labor Standards Act (FLSA). The Department of Labor (DOL) recently submitted its proposed changes to the FLSA overtime rules to the Office of Management and Budget (OMB). While any proposed changes may not be finalized for months, they’re expected to be significant. Therefore, having accurate, up-to-date job descriptions in place when these final rules go into effect may help your organization dramatically.
Remember that writing job descriptions shouldn’t be done solely by the human resources department. It’s imperative to include managers who know what’s needed from that position. In turn, HR should ensure managers understand the importance of identifying specific and necessary job functions and facilitating best practices.
So while your days are sunnier, be sure to polish those job descriptions; they likely need some color.
